在处理法律事务的过程中，用英文起草文稿，审核英文文件等是涉外法律人士的日常要务。这些看似基础的英语文书工作其实非常凸显律师法律英语的专业素养，而在日常写作中，又有很多常见的细节问题很容易被大家忽略，诸如法条引用、英文缩写、首字母大小写及标点的合理使用等这些所谓的“小”问题。今天，我们将就上述问题提供一些建议，希望能够帮助您将英文法律文书写得更加专业、更加地道。

中国法律的引用

 当在文书正文中引用法律条文时，请注意不要整段整句地全文引用。

 尽可能使用一般描述性语言概括法条，并用脚注进行辅助说明。

这是为什么呢？

因为读者希望能够在短时间内了解法条的大概内容。整段整句地引用法条会降低读者的兴趣，也不会额外提供任何实质性的信息。

正确引用示例：

文章正文：\"Chapter VI of the Civil Procedure Law provides the legislative framework for pre-trial evidence collection in China.[FN1] In 1991, the Supreme People’s Court supplemented the Civil Procedure Law by iuing evidentiary rules to guide the management of cases.[FN2]\"

脚注：\"FN1: See Civil Procedure Law of the People\'s Republic of China, effective on April 9, 1991; amended on October 28, 2007;further amended on August 31, 2012.\"

如何正确使用“etc.”

 Etc.是“et cetera”的缩写形式，意为“其他同类事物”。

 常被用来省略不必要全部列举出来的事物。但是只适用于同一种类的事物。如果不属同类则会误导读者。

举个例子，我们可以说“We could use cupcakes, cookies, etc.” 这说明除了杯子蛋糕和曲奇饼干之外，还有其他的甜点可以选择。因此也可以这样表达“We could use cupcakes, cookies, and other kinds of deert.”

但我们不能说“Bring hamburger buns, paper plates, cupcakes, etc.” 因为汉堡、纸盘和杯子蛋糕并不属于同一类别，读者不知道您想要的到底是什么。

 不要在法律文书中使用“etc.”。

法律文书力求简明精准。“Etc.”的用法比较模糊，界定过于宽泛，并不符合法律写作的要求。

如果您想要表达相同的意思，可以使用“including, among others, „.”这样的句式。

比如下面这句话\"Persons who perform public services in State organs are typical State Functionaries.They

include,e.g.,officials,directors,chiefs of bureau,etc.\"就可以改为\"State Functionaries perform public services in state organs.They include,among others,officials,directors,and chiefs of bureau.\"

除此之外，您还可以使用一个一般描述性的词语来结束以上的众多列举。就像这样\"They include, e.g., officials,directors, chiefs of bureau,etc.\"等同于\"They include officials,directors,chiefs of bureau,and other employees with managerial responsibilities.\"

首字母大写

 被定义项和专有名词通常需要首字母大写。

比如“London”或“Woolworths Company Limited”。











 被定义项的每一个词都需要首字母大写。比如“Sinopec Yangzi Petrochemical Company Limited”，介词和连接词除外（“Event of Default”中的“of”就不用大写）。在标题中只需要对第一个词语的首字母大写即可，被定义项除外。标题应写作“Your claim against ABC”而不是“Your Claim Against ABC”。请勿将整个词语全部大写。注意\"the Company\"不要写成\"the COMPANY\"。使用序列逗号序列逗号是指直接用在并列连接词（通常是指\"and\"、\"or\"或\"nor\"）连接三个以上事物之前的逗号。比如，\"France,Italy,and Spain\"（这里使用了序列逗号），而\"France,Italy and Spain\"（没有使用序列逗号）。逗号可以改变一个句子的意思。\"He eats shoots and leaves\"和\"He eats,shoots,and leaves.\"这两句话的意思就完全不一样。这是一个关于标点的笑话，原文的意思是“熊猫主食竹笋和竹叶”。而第二句多了两个逗号则变成“熊猫吃了东西，开枪射击之后又离开了”。意思完全改变了。序列逗号使得句意更加清楚。

例句：\"She took a photograph of her parents,the president and the vice president.\"

\"She took a photograph of her parents,the president,and the vice president.\"

第一句容易被误解为“她为她的父母——正副主席拍了张照片。”其实句子的正确意思应该是“她为她的父母和正副主席一起拍了张照片。”

如果并列连接词“and”和“or”无前置逗号的话，就会理解为将所列举的各个单独部分连接起来。

例句：\"He ordered scrambled eggs,whisky and soda and a selection from the trolley.\"

这句话的意思是“他在路边的小吃摊上点了一份炒鸡蛋，一杯威士忌和苏打和一份套餐”。这个句子少了一个序列逗号，就会产生误解。我们不清楚他到底是“点了一杯威士忌和一杯苏打”，还是“一杯威士忌加苏打”，后者在英美也非常常见。

而加上一个序列逗号后就十分清楚了，\"He ordered scrambled eggs,whisky and soda,and a selection from thetrolley.他点的就是“一杯威士忌加苏打”。

在新闻报道中通常会将序列逗号省略，但我们作为法律文件写作者，作为专业领域的作者，就要力求清晰严谨。

一位杰出的美国法律学者曾说过，“是否使用序列逗号引起了大家的广泛讨论。但毫无疑问的是，只要使用了序列逗号，就一定会避免不必要的误解。”

请勿使用“and/or”

 示例：“The Liquidated Damages apply if Party Amaterially breaches its obligations under the Tolling agreement and/or IP Licensing Agreement.”

这个句子想要表达什么呢？大意应为“当甲方违反了《设施使用协定》或《知识产权许可协议》两者中的任意一个或同时违反时都要支付违约金。

而\"The LDs apply if Party A breaches the Tolling Agreement or the IPLicensing Agreement.\"这句话表达的是相同的意思。但是这样表述起来就更加清楚，其实也可以这样表述\"TheLDs apply if Party A breaches one or the other or both agreements.\"

 如果您想要表达“X或Y，或者两者都包括”，可以写成“X or Y”。“or”本身就有包括的意思，除非文中对此做出了其他说明。

那么，“or”该怎样使用才是表达“不包括”的意思呢？（意思就是“or”表示为“X或者Y，不同时包括两者”）这时，我们应该使用“either”，这样就可以理解为“X或者Y”的意思。



示例：\"He will eat either brownies, cake, or pie.\" 意思就是他只会在布朗尼，蛋糕和派中间选择一样，不会都选。

合理使用“kindly”和“please”

 使用“please”就已经能足够表达礼貌之意，不必使用“kindly”。

请尽量避免如下表达：“Please kindly provide your comments by„,”或是“Kindly provide your comments by„.”其实说成“Please provide your comments by„.”就已经非常得体了。

金隆，本名张金龙，字天圣，笔名金石、天墨。祖籍山东莱芜，现定居北京，共和国同龄人。现为中国知名书法家、中国书画家联谊会会员、中国硬笔书协会员、中外书画艺术名人、黄河文化书画院院士；同时也是著名学者，精通古典文学，长于新闻、散文、诗词写作。

一、金隆艺术简历

金隆书法集《金隆书法管鉴》和书法册页《兰亭集序》出版

2011年春，由天津人民美术出版社结集出版的《中国知名书法家——金隆书法管鉴》正式出版发行了；随后，书法册页《兰亭集序》也结集出版。

《金隆书法管鉴》所选的近80幅作品是从金隆先生多年来原创作品中精选而来，字体以行草、行楷为主。作品有古今诗文、联句，也有金隆先生的自作诗文、自刻印章、自撰自书自刻的雕刻作品。书法集以金隆先生于《瀚海》杂志发表的散文《年年春草绿》为序言开篇，文章以优美的笔触、感恩的情怀，娓娓道出了自己的书法启蒙教育及感人至深的书法情结；书法集还披露了金隆先生的从艺历程、书家的金隆书法风格评论，以及近年来金隆先生参加的徐悲鸿纪念活动，与艺术大师马季、与日本友人的书法交流等部分书艺社会活动等。金隆先生表示，本书所选集的作品未加详细分类编排，以后将分类结集出版。

三、金隆书风

金隆书体风格：金隆书法基于柳楷，行师右军，后融古今书法名家，自成刚柔相济、飘逸隽永的独家书体。运笔流畅自如，疾驰有序，笔笔到位；结字华润灵动，筋骨内涵，风采外现；章法疏朗潇洒，虚实相携，渐达闲雅空灵、气脉贯通之境。

四、金隆书法艺术风格简析

●高启

有机会目睹金隆书法的人，无不称赞其美，溢美之词不一而足。金隆书法的确给人带来视觉上的审美享受和文化熏陶，然而究竟好在哪里，人们往往只能意会却难以言传。中国传统文化博大精深，加之金隆书法自成一体，对金隆书法的艺术风格不能尽述其妙，也就在情理之中了。然而，当笔者逐渐了解了金隆先生五十多年的书艺之路以后，对金隆先生的书法艺术风格才有了进一步的理解。

金隆先生的外祖父是清末举人，崇尚被奉为宫廷典范的“柳体”，习柳博学而仕途通达即是其外祖父的毕生追求，但也成了家传书风。金隆先生的母亲曾随其外祖父一起兴办私塾，在小金隆刚刚五岁的时候，便严格按私塾的方式教他正襟危坐习书柳楷，同时教他诵读《四书》、《五经》、《弟子规》一类的古文和格言。孩提时代的金隆虽未悉母亲的良苦用心和其中的确切含义，但七年的私塾化的启蒙教育，使其书法从柳公权“人正笔正”、“颜筋柳骨”中孵化而出，并初具雏形，为其后来的书法用笔打下了坚实基础。上中学以后，少年时代的金隆不满足柳体的刻板，开始临习王羲之的行书，以表达灵动活泼的情感。虽然当时他对王羲之《用笔赋》中提出的“藏骨抱筋，含文包质”的书法笔线美标准并不十分理解，但是以柳楷“立骨”的根基使其很快领悟了行书之妙，而且一临就是十年。仅《兰亭集序》就临过几百遍，时人皆称其书有右军之像。中学期间的老校长是一位书法造诣颇深的长者，共同的志趣使这对忘年交走到一起。老校长告诉他：书法非自立不能立于世，有人说赵孟頫的书法有妩媚之嫌，然而赵体却以风流倜傥、柔美华润而独立于书林，深受后世人所喜爱和称道。受群众喜爱的东西就是好的。老校长不流于世俗的朴素思想使金隆受益颇深，他反复审视自己所临右军行书，顿悟：数年临习，惟有形像，而无神似，于是他开始苦读和习悟赵孟頫和颜真卿的书帖，又先后悟读了毛泽东、郭沫若、赵朴初等当代书法大家的书法。先贤书法的神韵和精髓无不成为金隆书法生命的源泉。*期间的大字报，他不看内容只看字；观赏风景名胜，他只记匾额、题字和楹联；在农村插队时，劳动休息时间，他折草木为笔，在地上划沙习书；改革开放后路边林林总总的广告，他只记下其中某个字。参加工作以后，金隆的字常常深得同事和亲友的赞许，但只有金隆自己明白，临古人之法只能形似而不能神似，真正的得法之处在于符合自己之法，也就是符合自己的思想感情和个性需求。所以他把更多的业余时间用在了阅读书法理论和悟读书法名帖上，阅读、揣摩、研习，再阅读、再揣摩、再练习，书法充斥了他所有的业余时间和空间，就是在这样不断地总结沉淀，再总结再沉淀的过程中，使金隆书法终于破茧而出，渐渐走出了自己的书法之路。

了解了金隆书法历程，使我感觉到，人们赞扬金隆书法好，好就好在金隆书法得其法、悟其妙。

古人云：学书在法，其妙在人，师法则不能称其为书，依法方能得其妙。仔细揣摩金隆的书法，我们可以感到，用笔得法：或点或划，可谓笔笔到位，深得柳骨之风，提按转折，流畅自如，轻重适当。点划、结字之间，均可以使人感觉到书写过程中的疾迟、起伏、抑扬顿挫之节奏，这就是金隆先生所追求的以“笔舞”之意达“心舞”之情。 结字得法：结体严谨而不失疏朗空阔，灵动飘逸而不失刚直厚重。稳中求奇，奇中求趣，筋骨内涵，风采外现奇正、疏密、违和之中，隐现右军、颜柳之韵。也有友人说金隆书法有赵孟頫妩媚之态，金隆先生欣然表示：续之将探求拙辣之境。

布局得法：章法疏朗潇洒、闲雅空灵。章法是书法的统领，它体现一篇书法的整体气度。章法美的内涵是极其丰富的，它的变化多端远远超过了用笔与结体。历代书法家在章法上都极尽想象和渲染。金隆先生也不例外，他认为，对一篇书法整体章法的制定在下笔之前必了然于胸，并揣摩再三，不断总结，不断变化。被书友戏称为“定型产品”的书毛泽东《沁园春·雪》和杨慎《临江仙》，在章法上就充分体现了章法美的宾主分明、虚实相携、轻重相宜、气脉贯通之境，使金隆书法在章法上呈现疏朗潇洒、闲雅空灵的独特风格。

纵观金隆先生的学书之路还使我感到，金隆书法风格的形成还在于其深得融汇变化之妙。金隆先生认为，古今先贤其书各有所长，将其融汇变化，再重新结字成篇，则新意出焉。于是他在学理论、循法习字的基础上，广泛赏读古今名帖。在读帖时，先赏其点划、结字之美，细细体会其书写用笔之法，再试着把不同的点划按自己的想象重新结字，同时把点划加以变化，再把新结的字应用到整幅书法中去，最后根据书法布局的需要，结合运笔用墨加以变化。因此，在金隆的书法中，或可看到柳公权的稳重、颜真卿的结字严谨、王羲之的行草意韵、赵孟頫的柔润飘逸、赵朴初的稳重内涵以及毛泽东的挥洒磅礴„„或许这一切都没有看到，只看到了金隆书法，或许这就是金隆先生的苦心孤诣的融汇变化之妙吧。或许这一切都是笔者一人的枉加品评之砖，但愿求得方家卓见之玉。

五、金隆书苑随笔

书法艺术是情感的自然流动过程

书法所要表现的内容能够推动创作的激情时，书法作品会表现出意外的灵动、流畅，整体布局也会自然天成。

《兰亭序》即是如此。王羲之在聚会现场为飞扬的思绪所动，文思流畅，书法也流畅。而回到家中，刻意抄写时却无论如何也写不出现场的效果。所以，一幅书法作品需要作书前反复吟诵书作内容，构思每个字的结构和整体布局，切不要急于动笔，直到整体成熟于心、创作欲望膨胀、不得不写时再动笔，字从笔底流出，布局自然天成，才能成为好的作品。

书法——一气呵成的“功底型”艺术

书法艺术的高超境界在于它必须是一次性完成的整体艺术效果，从整体艺术布局到每个字的具体结构，都必须在创作前成竹于胸，稍有差错则会使通篇失色。这就要求书者既要有用笔的功力—每个笔划运笔到位，变化合适合理，又要有结字的功力—不同位置的每个字，大小结构、变化恰到好处；既要掌握笔的性能（不同动物毛笔的弹性、聚散性能），又要根据不同纸张的散墨性能，调试墨的浓淡；还要把握运笔结字的疾、徐。总之，要把这些诸多因素统一到一幅书法作品中，一次性完成每一个环节，直到整篇作品。而其他艺术品则可以进行反复修改、涂抹、补充、完善，来个“二次创作”。所以，在诸多艺术品中，书法作品的“技术含量”、“艺术含量”是最高的。

如果一幅成功的书法作品创作时间是20分钟，那么，他的实际创作时间就可能是在此基础上再加上30年。

书为用——我的书法观

“书为用”，乃书法之原本，而我谓之“书为用”，则是在书法已成为有一种艺术，已失原本之实用作用的今天，重新赋予思想文化内涵，而发挥其艺术魅力，使思想更具感染力。

我谓“书为用”，是现对将书法束之高阁，代价而估之现象而言。今日之书法，确为中国传统艺术之精华，然而也是以此宣传传统美德，为建设和谐社会做贡献之大好时机，即书法艺术大有作为之时，如不尽力付诸实践，发挥作用，岂不有负于创造如此良好环境之盛世耶？

六、文化积淀

加金隆工作期间，先后做过记者、编辑，担任编辑部主任、电台台长、报社社长兼总编辑、作家协会主席、文联主席等职务，在省级和国家级新闻媒体和文学杂志上发表新闻通讯、书法、散文、诗词、报告文学等作品百余篇。《年年春草绿》就是1992年金隆在《瀚海》杂志中发表的一篇散文，表达了他书艺启蒙教育及悠远的书艺情怀。

年 年 春 草 绿

每当河边的老柳树又泛出鹅黄，嫩嫩的春草又向大自然奉献出绿色，我便会情不自禁地重新回归到那童年的伊甸园。

那是一块隐匿在河滩柳丛中的濡湿的绿草地。春天，嫩嫩的茅草，绿绿油油，柔柔密密，或坐或卧都会让人感到惬意而迷离。倘若在千啾百啭的鸟鸣中听到“啪”的一声响起，便是一只漂亮的小鸟落入了扣网。夏季，坐在芳草纷披的岸边，把欢蹦乱跳的小鱼钓出水面，心便也随之欢跳。到了秋天，抱一抱柴草，把嫩嫩的玉米、大豆放在火里烧熟，那诱人的香气会让人把小脸吃成“花蝴蝶”„„

然而，这无忧无虑，让人无限留恋的童年生活却随着母亲的一记耳光而早早地结束了。

在我刚过完六周岁生日的那年春天的一个午后，我在河里玩乏了，便钻进了这“伊甸园”，光着身子躺在草地上。春阳透过交错的枝条和叶芽，晒得人暖融融的，随身揪下一朵紫色的、香气好浓好浓的小花，边晒太阳边慢慢地嗅，慢慢地嗅„„

朦胧中，我听到父亲和母亲在争吵。

“天都黑了，你就让他睡吧！”父亲用浓重的山东口音说。

“你不能这样疼他，不吃苦中苦，难得甜中甜。你总不能让他象你一样一辈子在土里刨食吧？”母亲像是开导父亲，又像是在质问父亲。我听出母亲是在生气，便仍躺在那假睡。

“可也是，老是让他在河边转也不是事儿，要不让他上学吧？”

原来，父亲已经沿河边整整找了我一下午，后来发现我睡在柳丛里，又不忍心把我叫醒，便把我抱了回来。

“不管怎么说，反正不严加管教不行，不能让他随心所欲。”

母亲曾代外公教过私塾，幼时的我常常听不懂母亲的话。但我却忽然想起母亲吩咐的每天三页毛笔字今天还没写，这是无论如何也躲不过去的，只好硬着头皮从炕上爬起来。

昏黄的油灯放在炕桌上，笔墨纸砚都已经摆好。我凑到桌前，按母亲教的姿势正襟危坐，迅速研好墨，在土黄色的草纸上一笔一划地写。母亲则站在我身后一声不响地看着。每当我写字的时候，母亲总是这样站在我身后，不时地提醒我。那次，母亲却一言不发，于是我也有些紧张，渐渐地走了神，字也写得松散无力，被母亲一下子从身后把毛笔拽了出去，接着便是“啪”的一记耳光。母亲一向对我管教很严，但动手打我却是第一次。我用手捂着火辣辣的脸，愣愣地望着母亲。

“记住，不许有第二回！”母亲看着可怜兮兮的我，声音有些哽颤，说完转身出去了。在屋编筐的父亲抬头望着母亲的背影又望望我无可奈何地叹口气，又继续编他的筐。

于是，我又打起精神，把第三页写完，便闷闷地睡了，第二天早上醒来的时候，我的眼睛被眵目糊粘得牢牢的。父亲急了，便用舌头一下一下的舔，用唾沫慢慢地洇。接着是母亲用湿毛巾慢慢地擦。眼睛睁开了，却什么也看不见，我还以为是黑天，嚷着让母亲点灯。父亲急得直跺脚、叹气。母亲紧紧地把我抱在怀里，一滴滴泪水滴湿了我的脸。

父亲背起我送往城里的医院。脚步那么急，那么重。我把脸贴在父亲的后背，渐渐地，父亲的后背变得湿漉漉的。

两个月后，我的眼睛奇迹般地复明了，且没有落下任何残疾。然而那令我依恋的乐园却很少属于我了。那年的夏天，我便随姐姐进了学校。从此，每天除了完成作业，便或是在母亲的“监视”下一笔一划地练字，或是听母亲讲那永远讲不尽的唐宗、宋祖、前清、民国，三十六计、二十四孝，以及头悬梁、锥刺股一类的故事。

在考入中学，准备离家的头一天晚上，母亲把我叫到身边，一反平日的严厉，慈祥而又略带忧郁的问我：“龙儿，你还记得娘打你的一记耳光吗？”

“娘，我记得，您那是为我好。”母亲的脸上露出了笑容，深情地说：“你懂事了。写字，聚气凝神方能有风骨；做人，正直坦荡方可立于世。今后，娘不常在你身边，遇事可要三思而行啊！”

After read \"The Quest for peace and Justice\" I realize that the problems we can meet that is not only include what we can always meet in our daily life, and there are many problems worthy paying our attention to understanding.Man kinds meet a lot of problems split recently, such as racial discrimination, poverty and war.

When I see the racial discrimination at the first time, my mind was a complete blank .It because that I had never direct acce to this before .The lifetime I live in is a small comfortable circle about my family and school, the relaxed situation has already made me lo the wandering consciousne.Back to the topic of racial discrimination, discrimination for me is not so strange, we live in a small circle, often encounter that someone has poor family condition.Such as the clothing, food, shelter and transportation of ancient them were quite simple.But I feel these two kinds of discrimination is not the same meaning.What I get from his article is that I realize what the meaning of racial discrimination is.To be discriminated from those black how helple, but because they are helple and I admire and love of the Martin, it is Martin\'s leadership allowed the discrimination against the blacks had, they acted to secure their own dignity, as Martin\'s quest for peace and justice in the representations of\" the majority of the people determined to end their nation and country suffered the exploitation and oppreion, they are awakening, and to the general goals of advancing towards them.

金锄头

《春秋谷梁传·成公元年》：“古者有四民。有士民，有商民，有农民，有工民。”我国农民始终采取自给自足的生产模式维持生计，他们面朝黄土，背朝天，世世代代挥舞着锄头只靠力气种田，他们没有什么文化和技术，只怨天灾虫祸，不思改变创新。他们已经很难跟随科技发展的脚步，他们需要一把新的锄头，一把金锄头。

首先这把锄头是金色的，是新科技、新知识、新技术赋予它耀眼的金色。我国农业科技在飞速发展不断创新，农业生产使用的机械与技术也越来越复杂，之前的“锄头”已经很难驾驭新的机械设备与技术，无法充分发挥科技的实际效用，导致了大材小用，资源浪费，已经无法适应农业可持续化发展的道路，现在急需的就是一把金色的锄头。

金锄头可以耕耘出金色的果实。它与现代农业发展的现实要求相适应，也更利于农业的可持续发展，可以使农业机械有了更大的用武之地，去年全国耕种收综合机械化水平达到54.5%，创历史新高，而经过5—10年的奋斗，我国实现农业机械化率要达到80%。正是金锄头推进了农业机械的发展使得农业生产效率大大提高。此外，通过金锄头还可以将新科技及时应用到生产实践中去，将劳动力、资源与科技更好地有机结合，使得种地更高产更高效。农业新品种的培育和应用，动植物病虫害防治技术的突破，资源高效型和环境友好型生产技术的推广等，已使我国科技对农业增长的贡献率从“一五”时期的19.9%，提高到目前的53.5%。

目前，我国农业劳动力减少，自然界可利用资源也是有限的，而人类对物质的需求却是无限的，要突破资源的束缚只能依靠科技，农业的发展需要在科技创新、推广和应用的引领，实现农业现代化需要的不是数量更多的农民，而是让种田农民拥有金锄头。

今天的中国处在从传统农业向现代农业加快转变的关键阶段，城市需要有职业素养、适应岗位要求的就业者，农村同样需要有生产技术、懂生产经营的职业农民。正如回良玉在全国现代农业建设现场交流会上指出的：培养一大批“以农业为职业、占有一定的资源、具有一定的专业技能、有一定的资金投入能力、收入主要来自农业”的新型职业农民，不断增强现代农业发展活力。社会主义新农村呼唤建设者从传统意义上的农民走向新型的职业农民。 而拥有金锄头正是成为新型职业农民的必备条件，拥有金锄头的农民是新型职业农民的新鲜血液，他们必将成为新型职业农民，成为现代农业理念和技术的承接者和传播者，成为农业科技“二传手”和现代农民中的佼佼者，成为发展现代农业的主力军，成为农村先进生产力的典型代表。

在广阔的田野上，他们将站的更高，看的更远，充分发挥科学技术，大幅提升农业生产率，新技术、新设备、新理念的花朵将在田野上绽放，散发出无穷活力，用金色的锄头耕耘出金色的果实。
