4、乙方不得在该物业之内任何地内存放违反危险品条例之物品,例如军械、火药、璜硝、汽油, 有爆炸危险性的物品及挥发性之化工原料等等, 另乙方不得在该物业内做任何 违反中国法律行为。否则,一切后果,由乙方负责。

5、乙方须正确维护该物业内甲方所提供之家具、电器、装置及设备、该物业之原来一切设 备如有因非正当使用造成的损坏,乙方须负责修理或赔偿。

to keep the interior of the said premises and furniture, fixtures and fittings provided by party a in condition of normal use throughout the tenancy, if any damages made by any abnormal use, party b is responsible for the repair or reimbursement.

6、乙方不得拒绝甲方派谴之人员,在适当时间入屋检视该单位近况或进行任何修理工程。 party b shall permit party a and its agents with or without workmen or others and with or without appliances at all reasonable times to enter upon the said premises and to view the condition thereof and to take inventories of the fixtures therein and to carry out any repairs to the premises which party a considers neceary or proper to be done.

7、当租约期满或终止前x个月,甲方有权在不骚扰原则下, 张贴招租告示于该单位外, 乙方亦应准许甲方/代理人在合理时间内,带同新租客进入该物业视察。 during the x month immediately preceding the determination of the said term of tenancy, party a shall be at liberty to affix and retain without interference or molestation on the door or the external parts of the said premises a notice for letting the said premises and the party b shall permit and allow all persons with written or oral authority from party a or its agent or agents at all reasonable hours of the day to view the said premises or any part or part thereof.

8、租约期满,乙方如需延长租约,须在租约期满 x 个月前以书面方式通知甲方,经甲 方同意,乙方可以新订租金和租约继续入住该物业。

10、乙方不得于单位内制造或容许制造噪音, 异味或任何滋扰邻居或业主安宁之举动, 其中包括拖欠租金。经警告后仍未有所改善, 甲方有权终止租约。

12、甲方须承担该物业的房产税、土地使用税。 party a shall pay all property tax, land tax and any other tax or charge of the said premises.租约期内,甲方有权将该物业出售给第三者,本合约对购得该物业之新业主仍然有效,

所有适用于甲、乙双方的条款,同样无条件适用于新业主和乙方。

during term of tenancy, party a shall have the right to sell the said premises to the third party.the terms and conditions here in contained which applicable to party a and party b must be applicable to the new landlord and party b without negotiation.

13、本合约之附件,包括:家具装置设备清单、房屋所有权证副本,租赁协议书,均为本合 约不可分割的成部分。

五、保证金 deposit 1.为确保房屋及其附属设施之安全与完好,及租赁期内相关费用之如期结算,乙方同意于______年_____月_____日前支付给甲方保证金人民币 _________元整,甲方在收到保证金后予以书面签收。

unle otherwise provided for by this contract, party a will return full amount of the deposit without interest on the day when this contract expires and party b clears the premises and has paid all due rental and other expenses.3.因乙方违反本合同的规定而产生的违约金、损坏赔偿金和其它相关费用,甲方可在保证金中抵扣,不足部分乙方必须在接到甲方付款通知后十日内补足。

六、甲方义务 obligations of party a 1.甲方须按时将房屋及附属设施(详见附件)交付乙方使用。 party a will provide the premises and attached facilities (see the appendix of furniture list for detail) on schedule to party b for using.2.房屋设施如因质量原因、自然损耗或灾害而受到损坏,甲方有修缮并承担相关费用的责任。 in case the premise and attached facilities are damaged by quality problems, natural damages or disasters, party a will be responsible to repair and pay the relevant expenses.3.甲方应确保出租的房屋享有出租的权利,反之如乙方权益因此遭受损害,甲方应负赔偿责任。

七、乙方义务 obligations of party b 1.乙方应按合同的规定按时支付定金、租金及保证金。

party b will pay the rental, the deposit and other expenses on time.2.乙方经甲方同意,可在房屋内添置设备。租赁期满后,乙方将添置的设备搬走,并保证不影响房屋的完好及正常使用。party b may decorate the premises and add new facilities with party as approval.when this contract expires, party b may take away the added facilities which are removable without changing the good conditions of the premises for normal use.3.未经甲方同意,乙方不得将承租的房屋转租或分租,并爱护使用该房屋如因乙方过失或过错致使房屋及设施受损,乙方应承担赔偿责任。 4.乙方应按本合同规定合法使用该房屋,不得擅自改变使用性质。乙方不得在该房屋内存放危险物品。否则,如该房屋及附属设施因此受损,乙方应承担全部责任。

party b will use the premises lawfully according to this contract without changing the nature of the premises and storing hazardous materials in it.otherwise, party b will be responsible for the damages caused by it 5.乙方应承担租赁期内的水、电、煤气、电讯、收视费、等一切因实际使用而产生的费用,并按单如期缴纳。

八、合同终止及解除的规定 termination and diolution of the contract 1.乙方在租赁期满后如需退租或续租,应提前两个月通知甲方,由双方另行协商退租或续租事宜。在同等条件下乙方享有优先续租权。

within two months before the contract expires, party b will notify party a if it intends to extend the leasehold.in this situation, two parties will discu matters over the extension.2.租赁期满后,乙方应在当天将房屋交还甲方;任何滞留物,如未取得甲方谅解,均视为放弃,任凭甲方处置,乙方决无异议。 when the lease term expires, party b will return the premises and attached facilities to party a within days.any belongings left in it without party as previous understanding will be deemed to be abandoned by party b.in this situation, party a has the right to dispose of it and party a will raise no objection.3.本合同一经双方签字后立即生效;未经双方同意,不得任意终止,如有未尽事宜,甲、乙双方可另行协商。

this contract will be effective after being signed by both parties.any party has no right to terminate this contract without another partys agreement.anything not covered in this contract will be discued separately by both parties

九、违约及处理 breach of the contract 1.甲、乙双方任何一方在未征得对方谅解的情况下,不履行本合同规定条款,导致本合同中途中止,则视为该方违约,双方同意违约金为人民币___________元整,若违约金不足弥补无过错方之损失,则违约方还需就不足部分支付赔偿金。

if party b fails to pay the deposit or other fees payable under this contract, or party a has paid for party b such other fees payable by party, party b shall pay late payment interests for the period of late payment at the rate of 0.5‰ of the outstanding amount per day.如乙方未能按照本合同规定支付应付的保证金和其他款项给甲方,或甲方为乙方垫付应由乙方支付的其他款项,乙方应付迟延支付期间的迟延利息,该迟延利息应按日息为所欠款项的0.5‰计算。

6.1 party a shall ensure that the construction structure and the equipment and facility of the premises conform to the safety conditions concerning construction, fire prevention and others, and the premises has not any danger to the personal safety.party b shall ensure that the relevant laws and regulations of national or beijing government shall be observed during use of the premises.6.1甲方应保证房屋的建筑结构和设备设施符合建筑、消防等方面的安全条件,不得危及人身安全;乙方应保证在使用过程中遵守国家、北京市的相关法律法规规定。? 6.2 during the term, both parties shall ensure that the premises and its contents, equipment and facilities are in usable and safe condition: 6.2租赁期内,甲乙双方应共同保障房屋及其附属物品、设备设施处于适用和安全的状态: 6.2.1对于房屋及其附属物品、设备设施因自然属性或合理使用而导致的损耗,乙方应及时通知甲方修复。甲方应在接到乙方通知后的7日内进行维修。逾期不维修的,乙方可代为维修,费用由甲方在合理合法范围内承担。 6.2.2因乙方保管不当或不合理使用,致使房屋及其附属物品、设备设施发生损坏或故障的,乙方应负责维修或承担赔偿责任。

1.rights and obligations of party a 2.甲方权利及义务

7.1 party a hereby guarantees that party a is the legal owner and has the right to lawfully lease the premises.otherwise, party a shall bear the legal liability arising therefrom in full.7.1 甲方保证是项目合法的拥有者,其有权合法出租该单元,否则产生的法律责任均由甲方承担。

7.3 甲方保证在租期内,乙方将有权平静地占有和享用该单元,不会受到甲方或甲方代理人的干扰,但前提是乙方支付了本合同规定的租金和其它费用,并遵守和履行了本合同规定的应由乙方遵守和履行的条款。

7.4 party a has the right to terminate this contract unilaterally upon occurrence of any of the following to party b: 7.4 乙方出现下列任何情况时, 甲方有权单方解除本合同。

7.4.1 violates the laws or the regulations of prc or uses the premises for illegal busine operations; 7.4.1 违反中华人民共和国的法律/法规, 利用该单元进行不法经营活动; 7.4.2 changes the uses of the premises without consent of party a; 7.4.2 未经甲方同意擅自更改该单元的用途;

7.4.3 fails to pay the rent pursuant to relevant provisions hereunder; or 7.4.3 未按本合同的有关条款缴纳租金;或 7.4.4 sub-lets the premises or parts of the premises to others, transfers the premises to others or uses the premises jointly with a third party without the consent of party a.7.4.4未征得甲方同意, 擅自将该单元或该单元的部分转租、转让给第三方或与第三方共同使用。

7.5 party b agrees to waive its right of first refusal in respect of the premises voluntarily and unconditionally during the term.during the term, party a shall be free to transfer the premises to any third party, provided that such transfer shall not prejudice party b’s rights to occupy, control and use the premises in accordance with the terms and conditions of this contract.if party a transfers the premises to a third party, such third party shall continue to enjoy and bear all rights and obligations of party a under this contract.party b undertakes to cooperate in full with party a in handling the relevant formalities to sell and hand-over of the premises.party b’s failure to cooperate for the hand-over shall not affect the aumption of the rights and obligations of this contract by the new owner.party b shall pay rent to the new owner in accordance with this contract after receipt of party a’s notice, otherwise party b shall bear the liability for breach of contract and late payment under this contract.7.5在租期内,乙方自愿无条件放弃该单元的优先购买权。在租期内,甲方有权自由转让该单元予任何第三方,但是该转让不得影响乙方根据本合同的条款和条件占有、控制和享用该单元的权利。若甲方将该单元出售予第三方,第三方将继续享有和承担甲方在本合同项下的所有权利和义务。乙方承诺充分配合甲方办理该单元的出售及交接手续,不影响新业主开始继受出租方在本合同项下的权利义
