With respect to sales of the stock house, Party A and Party B have signed Beijing Stock House Sales Contractparties now sign this agreement according to Notice on Establishing Stock House Transaction Service Platform.
Article 1No.) and No.of as stock house transaction fund supervising account (short for “supervising account” hereinafter), Party B is willing to deposit his or her owned transaction fund (short for “owned fund” hereinafter) specified in Beijing Stock House Sales Contract into the supervising account and Party C is entrusted to supervise it.If the transaction is finished, the owned fund and deposit interest incurred during the depositing period of the supervising account will be owned by Party A.If the transaction between Party
A and Party B fails, principal and interest in the account will be owned by party B.opened by transaction is finished.ofopened by Party B in when the transaction fails.
Article 2 Fund supervising term: from the day when Party B deposits his or her owned fund into the supervising account to the day when the property right transferring registration of the house transacted by Party A and Party B is finished and the owned fund is transferred to Party
A.
If the transaction fails, the fund supervising term will be from the day when Party B deposits his or her owned fund into the supervising account to the day when Party A and Party
B cancels the stock house contract signed on line and the owned fund is transferred to Party
B.
Article 3 Party C’s supervising obligation: during the supervising period, Party C should iue an electronic instruction via the stock house transaction service platform to require the supervising bank to transfer the owned fund in the supervising account.With respect to fund loes of the two parties transacting the stock house due to Party C’s reasons, Party C should undertake corresponding responsibility for compensation.
When any one of the following condition occurs, Party C can iue an electronic instruction via the stock house transaction service platform to relieve his or her supervision over the supervising account and transfer the owned fund deposited into it by Party B into1
Party B’s account.
1.Party A and Party B unanimously agree to relieve Beijing Stock House Sales
Contract and have gone through procedure for canceling the contract signed on
line and gained Party C’s confirmation.
2.When Party A and Party B go through procedures for house transferring
registration, it cannot be made as the registering condition is not met through the
examination of the house property right registration department.
3.Due to limitation of authorized organ and other conditions not reaching a
transaction.
Article 4 Any dispute incurred during the stock house transacting period can be settled by Party A and Party B through negotiation and Party C will not intervene into their dispute.Meanwhile, Party C will not undertake any other liabilities except supervising fund specified in the agreement.
Article 5 If certain authorized organ freezes or transfers the supervising fund, Party C will not undertake any liability for the freezing or transferring behavior and any easily-caused result but have the obligation to aist the supervising bank in proving the nature of the supervising account and fund.
Article 6 The agreement will come into effect after Party A and Party signs their names or affixes their seals and Party C affixes his or her seals.
Article 7 The agreement is in triplicate and the three parties signing the agreement respectively keep one.
Article 8 Any dispute incurred during the performing of the agreement should be settled by the three parties through negotiation.If the negotiation fails, they will agree to settle it 1.Any one can sue to the People’s Court in the place wherein Party C is located;
2.Submit to Beijing Arbitration Committee for arbitration.
