众所周知，法律在美国社会发挥着至关重要的作用，获得了美国民众的信赖和尊崇。从美国人对法官与律师的尊重和信赖，可以较为准确地反映出其对待法律的态度。对法律的信仰构成了美国文化中一个引人瞩目的现象。他们相信任何人哪怕是最高级的官员都不能免受法律的管制。我们对这一问题——美国人为什么对法律有一个如此之深的信仰？
As we know, law has been playing an important role in America and has gained great trust and respect of American people.From their respect of the American judges and lawyers, we can see their faith in law accurately.And this is a remarkable phenomenon in American culture.They believe that everyone even the most senior officials are not immune from the control of law.Our group is interested in the problem——why Americans have deeply faith in law? Now let’s begin.
提到法律信仰我们不得不提及伯尔曼的《法律与宗教》这本书，正如作者在书中所述一样，法律必须被信仰，否则形同虚设。从这本书里我们了解到，西方社会的法律与宗教间的相互影响和相互依赖有着很深的历史、文化基础——它们都建立在“理性”的基础上。西方人对法律的尊崇的一个原因是对宗教的信仰，源自于对上帝的信任以及对自然法的尊崇。但是对法律的信仰不仅仅局限于此，如果我们对伯尔曼的理论进行创造性的转化，就会发现，在现实社会中对法信仰的具体指向的是对宪法的信仰。美国宪法中规定了保护公民权利的条款。美国的《独立宣言》中也同样写明：“人人生而平等,造物主赋予他们若干不可让与的权利,其中包括生存权、自由权和追求幸福的权利。”所以我们说一个是绝对意义上的法律，它通常等同于“权利”，对法律的信仰便是对权利的信仰。美国人普遍敢于为自己的权利奋斗，而这正体现了他们对法律的尊重之情。我认为有以下几个原因：
一、一个正义观念成熟并且深入人心的公民社会。美国在过去两百年的发展中,契约精神深入人心,自由平等的观念不仅仅是美国人的口号,也是他们努力的方向。
二、一套最大限度保护公民权利的政治制度。这套政治制度能够尽其最大限度保护公民的基本权利不受无序的侵犯。
三、独立的司法保证司法制度最大限度的正规运行。所以，我认为他们对法律有足够的信心。 我认为有以下几个原因：
一、一个正义观念成熟并且深入人心的公民社会。美国在过去两百年的发展中,契约精神深入人心,自由平等的观念不仅仅是美国人的口号,也是他们努力的方向。
二、一套最大限度保护公民权利的政治制度。这套政治制度能够尽其最大限度保护公民的基本权利不受无序的侵犯。
三、独立的司法制度保证权利能够获得救济。所以，我认为他们对法律有足够的信心。
Referring to the legal faith, we have to mention the book written by Harold.J.Berman, Legal and Religion.As the author said in the book, Law must be believed in, otherwise it is usele.From the book we learn that interaction between law and religion in Western society has deep historical and cultural foundation——they are both based on the \"reason\".One of the reasons why they have belief in law is that they have belief in religion, from trust in God and respect of natural law.But faith in the law is not limited to this.If we creatively expand Berman’s theory, we can find that, in reality the law of faith means the faith of the Constitution.And American Constitution contains several clauses protecting people’s civil rights.In the United States Declaration of Independence, it states that all men are created equal, that they are endowed by their Creator with certain unalienable rights, that they are among these are life, liberty and the pursuit of happine.So we call that an absolute sense of the law is usually the same as right, faith in law is just faith in right.And Americans generally dare to struggle for their rights,which reflects their belief in law.I think there are several reasons for this.First, the concept of justice has deeply taken roots in American society.In the past two hundred years of development, spirit of the contract enjoys popular support the United States.The concept of freedom and equality is not just the American slogan, but also the direction of their efforts.Second, a political system that maximizes to protect citizens\' basic rights from disorderly harming.Third, an independent judiciary to ensure rights can get enough relief.So I think they have great confidence in law.
