英文房屋租赁合同Rental Contract

Rental Contract Leor (hereinafter referred to as Party A) :

Leee (hereinafter referred to as Party B) :

In accordance with the relevant national laws and regulations as well as the relevant stipulations of the city, Party A and Party B have reached an agreement through friendly consultation to conclude the following contract.

Article 1: Party A guarantee to Party B that they have completely ownership and use right of the premise; Party B ensure that they understand the whole picture of the house, and based on the present condition.Article 2: The premise is located at_______ with the construction floorage of _____square meters.The premises and the attached facilities are in good condition.Water, electricity, gas, heating is supplied normally.(The gas electricity meters appears as__; The electricity meters appears as__) The lease term will be from _____ (month) _____ (day) _______ (year) to ________ (month) _____ (day) ______ (year).Article 3: The rental will be__RMB per month (Party B shall pay for the management and garbage collection of the community).Article 4: Payment of rental will be one installment every six months.From the effective date of the contract, Party B should pay the first installment of __yuan to Party A in advance.Each succeive installment shall be paid 10 days before the end of the term.The rental should be paid in the form of cash.Party B shall pay Party A a deposit of__yuan with the first installment.Party A will iue a written receipt after receiving the payment and the deposit.After the contract expired, Party A shall refund the deposit in full amount without interest to Party B if the premise is in good condition; if damaged, the original price shall be deducted according to the actual extent of damage or the value of the damaged goods, Party B shall fill the insufficient.

Article 5: Party B will bear the cost of utilities such as gas, water, electricity, heating, telephone communications, cable TV and network usage charges and security fees on time during the lease term.Article 6: During the lease term, Party B shall not sublease the house to a third party, otherwise, Party A shall have the right to unilaterally terminate the contract and recover the housing, and Party B\'s breach of contract can be investigated.Article 7: During the lease term, Party A shall be responsible for normal maintenance of the housing, or commiioned by the leee to act as repair, maintenance costs are borne by Party A.Party A shall ensure that the housing can meet the normal use and residential needs of Party B.Article 8: During the lease term, if the premise had some damage not caused by Party B, such as the natural damage or man-made damage, or roof leakage, affecting normal life of Party B, Party A shall be repair the damage within seven days from the date of receiving the notice from Party B.If more than seven days Party B has the right to repair itself, and the repair expenses should be borne by Party A.Article 9: During the lease term, if Party A does need to take back the house for self-occupation, Party A must give a written notice to Party B one month in advance.After the termination of the contract, Party A shall pay penalty to Party B which account for 5% of the total rental of the remaining lease term.Article 10: If Party B needs to return the premise during the lease term, a written notice should be given to Party A one month in advance.The two parties agree to terminate the contract through consultation.Party B shall pay penalty to Party A which account for 5% of the total rental of the remaining lease term.Article 11: Party B change the structure and use of the housing without approval of Party A, cause damage to the rented housing and equipment intentionally or negligently, shall be responsible for restitution or compensation for economic loes.If Party B wants to decorate wall, install windows and prior approval from Party A.Article 12: The interior decoration and the installation of equipment, items attach to Party B can be transferred to Party A in a discount when the contract expires.If the two parties cannot reach an agreement, Party B shall remove them within seven days from the date of termination of the contract.For more than seven days, Party A shall have the right to retain free of charge or remove by themselves, the cost of removal shall bear by Party B in a reasonable amount.Article 13: Early termination of the contract or after the contract expires according to the contract, Party B shall move out of all equipment and items within fifteen days from the date of receiving a formal written notice from Party A, unle the two parties have other consultation.If Party B does have difficulties in finding another house in short term or other special circumstances, Party A shall allow Party B an extension of 30 days, however, Party B shall pay the entire rental which the contract set at one time.If there is still belongings left by Party B after seven days of the removal, it will be deemed to be abandoned by Party B and Party A has the right to dispose it , unle the two parties have other agreement Article 14: If Party B fails to move after lease expiration or termination of the contract, Party B shall compensate for Party A the economic loes.Article 15: Within one month before the contract expires, Party B will notify Party A if it intends to extend the leasehold.After receiving the written notice, Party A can raise an objection or discu matters over the extension with Party B within 30 days.If Party A does not give a written reply to Party B during the 30 days, it will be deemed to give tacit consent to renew the premise.This contract is automatically extended for one year, from the next day of the expiration of 30 days.Article 16: Any dispute arising from the contract or in connection with the contract should be settled through friendly discuion between the two parties.If no settlement can be reached through discuion, both parties shall have right to sue with the people’s court, which has jurisdiction over the matter.Article 17: This contract shall go into effect the moment it is signed by both parties and shall abide by the administrative laws and regulations.Article 18: If Party B delays such rental payment, the interest would be imposed on overdue account at a daily rate of 20% of month rental.If Party B still delays in the exce of ten working days, party A shall terminate the contract unilaterally and has the right to take back the premise.Party B shall be investigated for breach of the contract.Article 19: This contract is made of 4 copies and each party will hold 2 copies which shall have the equal legal bindings.Article 20: If Party A or Party B has any specific matters, it may be agreed upon by both parties in this separate clause.Supplementary provisions of the agreement have the same effect.Article 21: This contract will be effective after being signed by both parties.
